TERMS OF SERVICE

1. AGREEMENT TO TERMS

These Terms of Service ("Terms") constitute a legally binding agreement between you and National Honor Society: Manage ("we," "us," or "our") concerning your access to and use of the National Honor Society: Manage mobile application (the "App") available on the Apple App Store and any related services (collectively, the "Services"). These Terms are between you and us only, and not with Apple, Inc. ("Apple").

By accessing or using the Services, you agree that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Services.

2. ELIGIBILITY

You must be at least 13 years of age to use the Services. By using the Services, you represent and warrant that:

You are at least 13 years of age
You are a member, officer, or administrator of a National Honor Society (NHS) or National Honor Society Associates (NHSA) chapter
You have the legal capacity to enter into these Terms
You will provide accurate and truthful information when creating your account

If you are under 18 years of age, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. USER ACCOUNTS

3.1 Account Creation

To use the Services, you must create an account by providing accurate and complete information, including:

Full name
Email address
Phone number
Student ID
Grade level
Organization affiliation (NHS or NHSA)
Verification code provided by your chapter administrator

3.2 Account Security

You are responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Notifying us immediately of any unauthorized access or security breach
Ensuring your account information remains accurate and up-to-date

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time, without notice, for conduct that we believe:

Violates these Terms
Is harmful to other users, third parties, or our business interests
Involves fraudulent or illegal activity

4. ACCEPTABLE USE

4.1 Permitted Use

You may use the Services only for lawful purposes and in accordance with these Terms. Specifically, you agree to:

Use the App solely for managing your NHS/NHSA chapter activities
Provide accurate information when submitting volunteer hours
Respect the privacy and rights of other users
Comply with all applicable local, state, national, and international laws

4.2 Prohibited Conduct

You agree NOT to:

Use the Services for any illegal purpose or in violation of any laws
Submit false, misleading, or fraudulent information, including volunteer hours
Impersonate any person or entity, or falsely state or misrepresent your affiliation
Harass, abuse, threaten, or intimidate other users
Attempt to gain unauthorized access to the Services, other accounts, or computer systems
Interfere with or disrupt the Services or servers connected to the Services
Use any automated means (bots, scrapers, etc.) to access the Services
Reverse engineer, decompile, or disassemble any part of the Services
Remove, circumvent, or disable any security features or access controls
Upload or transmit viruses, malware, or any other malicious code
Collect or harvest personal information about other users
Use the Services to send spam, advertising, or promotional materials

5. VOLUNTEER HOURS AND EVENT TRACKING

5.1 Accuracy of Information

You agree to submit accurate and truthful information regarding:

Volunteer hours worked
Event attendance
Supporting documentation or proof of service

5.2 Verification and Approval

All submitted volunteer hours are subject to review and approval by chapter officers and administrators. We do not guarantee approval of any submitted hours.

5.3 Consequences of False Information

Submitting false or fraudulent volunteer hours may result in:

Rejection of submitted hours
Suspension or termination of your account
Disciplinary action by your school or chapter
Potential legal consequences

6. ATTENDANCE TRACKING

The App uses Bluetooth technology to facilitate automatic attendance check-in at events. By using this feature, you acknowledge that:

Bluetooth access is required for automatic check-in functionality
Location permissions may be required by your device's operating system for Bluetooth functionality
We do not collect or store your GPS location data
Attendance records are maintained by your chapter administrators

7. INTELLECTUAL PROPERTY RIGHTS

7.1 Our Rights

The Services, including all content, features, and functionality, are owned by National Honor Society: Manage and are protected by copyright, trademark, and other intellectual property laws. The App is licensed, not sold, to you. You may not:

Copy, modify, distribute, or create derivative works of the Services
Use our trademarks, logos, or branding without written permission
Remove or alter any copyright, trademark, or proprietary notices

7.2 User Content

You retain ownership of any content you submit through the Services (photos, documents, etc.). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and display such content solely for the purpose of providing the Services.

8. THIRD-PARTY SERVICES

The Services may contain links to or integrate with third-party services, including:

Social media platforms (for optional login)
Cloud storage services
Analytics and error tracking services

We are not responsible for the content, privacy policies, or practices of any third-party services. Your use of third-party services is at your own risk and subject to their respective terms and conditions.

8.1 Apple-Specific Terms

With respect to the App obtained through the Apple App Store, the following additional terms apply:

These Terms are between you and us only, and not with Apple. Apple is not responsible for the App or its content.
Your use of the App must comply with the App Store Terms of Service.
In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App (if any).
Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
Apple is not responsible for any claims relating to the App, including product liability claims, failure to conform to any legal or regulatory requirement, and consumer protection or similar legislation.
In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, we will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

9. PRIVACY

Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

10. DISCLAIMERS

10.1 "AS IS" Basis

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. IN NO EVENT SHALL APPLE BE LIABLE FOR ANY CLAIMS, LIABILITIES, DAMAGES, LOSSES, OR EXPENSES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

10.2 No Guarantee of Availability

We do not warrant that:

The Services will be uninterrupted, secure, or error-free
Defects will be corrected
The Services are free of viruses or other harmful components
Results obtained from using the Services will be accurate or reliable

10.3 Educational Use Only

The Services are designed to assist with chapter management and record-keeping. We make no representations regarding the accuracy or completeness of volunteer hour records or their acceptance by educational institutions, scholarship programs, or other third parties.

11. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NATIONAL HONOR SOCIETY: MANAGE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

Loss of data or information
Loss of profits or revenue
Loss of opportunity
Costs of substitute services
Personal injury or property damage

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS LESS.

12. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless National Honor Society: Manage and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to:

Your use of the Services
Your violation of these Terms
Your violation of any rights of another person or entity
Any content you submit through the Services

13. MODIFICATIONS TO SERVICES

We reserve the right to:

Modify, suspend, or discontinue the Services at any time
Change features, functionality, or availability of the Services
Impose limits on certain features or restrict access to parts of the Services

We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Services.

14. CHANGES TO TERMS

We may update these Terms from time to time. When we make changes, we will:

Update the "Last updated" date at the top of these Terms
Notify you through the App or via email
Provide you with an opportunity to review the updated Terms

Your continued use of the Services after changes become effective constitutes your acceptance of the revised Terms.

15. GOVERNING LAW AND DISPUTE RESOLUTION

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

15.2 Informal Resolution

Before filing a claim, you agree to contact us at contact.nhsapp@gmail.com to attempt to resolve the dispute informally.

15.3 Arbitration

Any dispute arising out of or relating to these Terms or the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.

16. SEVERABILITY

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. WAIVER

No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

18. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, constitute the entire agreement between you and National Honor Society: Manage regarding the Services and supersede all prior agreements and understandings. The failure of us to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

19. APPLE-SPECIFIC ACKNOWLEDGMENT

You acknowledge and agree that:

These Terms are between you and National Honor Society: Manage only, not with Apple, and Apple is not responsible for the App or its content.
Apple has no obligation to furnish any maintenance and support services with respect to the App.
In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you.
Apple is not responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App.
Apple is not responsible for the investigation, defense, settlement, and discharge of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights.

20. ACKNOWLEDGMENT

BY USING THE SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE AND AGREE TO BE BOUND BY THEM.
